What are the types of child custody?
In North Carolina, there are two types of child custody: physical custody and legal custody. Where physical custody refers to with whom and when the child will reside, legal custody refers to who has decision-making authority over the child. For each type, sole and joint custody are possibilities.
Is North Carolina a “no-fault” state for divorce?
Yes, it is. In North Carolina, the spouse who files for divorce does not need to show there was cause for the divorce or that one spouse did something wrong that warrants divorce. To get a no-fault divorce, you and your spouse must have lived separately and apart for a minimum of 12 consecutive months, and at least one party must have been a resident of North Carolina for at least 6 months before starting divorce proceedings.
